By continuing to shop on our Pantoneclo online shop, you acknowledge and accept all the general terms and conditions. Pantoneclo reserves the right to change these conditions at any time. All changes are legally binding to customers and Pantoneclo, so we recommend that you regularly review the terms of the agreement.

General Terms and Conditions

The General Terms and Conditions of www.pantoneclo.com are based on the provisions of the Consumer Protection Act (ZVPot-1), the Personal Data Protection Act (ZVOP-1), the Electronic Communications Act (ZEKom-1), and the recommendations of the Chamber of Commerce and Industry as well as international e-commerce codes.

These Terms and Conditions of Sale set out the rights and obligations of buyers and visitors to the website www.pantoneclo.com (hereinafter referred to as: “User”) when ordering products available on the website, as well as the business relationship between the Provider and the User.

The entire content of the website, regardless of format (text, images, films, sounds, etc.), is protected by copyright. The content may not be used for any purpose other than viewing the website, making purchases, and communicating with the User, unless otherwise expressly permitted in writing by the Provider (“Pantoneclo”). In the event of any misuse or unauthorized use of individual content, the Provider will protect their interests through legal remedies.

These are the legal terms and conditions under which We (“Pantoneclo”) supply the products listed on our website www.pantoneclo.com to you. Using our site indicates that you accept these terms and conditions along with our privacy notice and terms of use, regardless of whether you choose to register with us.

The buyer is bound by the general conditions in force at the time of purchase (online order). At the time of the order, the user is reminded of the general conditions of the contract and confirms his knowledge by placing the order.

  Buyer Status

You may only purchase Products from us if:

1. You are legally capable of entering into a binding contract with us (for example, in Slovenia you must be at least 18 years old);

2. You are an authorized user of the credit or debit card or payment account (i.e. Paypal, Stripe other debit, credit or master card) used to pay for your order; and

3. You are a resident of a country that we deliver to.

Personal Data Protection

Pantoneclo undertakes to permanently protect all personal data of the user in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and ZVOP-1. The user must provide their personal data correctly and truthfully and inform Pantoneclo of any changes. By accepting these terms and conditions, the user confirms that the personal data provided is correct.

Use of Personal Information

1. We use the personal information you provide to process your orders and deliver them to your preferred shipping address. This includes communicating with you about your order status and providing necessary updates.

2. We may use your personal information to respond to your inquiries, provide customer support, and address any issues you may have with our products or services.

3. With your consent, we may send you promotional emails or newsletters about our products, special offers, abandoned checkouts, or upcoming events. You can opt-out of receiving such communications at any time by following the unsubscribe instructions included in the emails or contacting us directly.

How the Contract is Formed Between the Consumer and Pantoneclo

1. Once you have placed your order, you should receive an email from us acknowledging that we have received your order (please contact us if you do not receive this email). Please note this does not mean that your order has been accepted. All orders are subject to availability and acceptance by us (which we may refuse for any reason).

2. After you submit your order, either on prepayment by credit or debit card or COD (Cash on Delivery) basis, the product is being processed and prepared for dispatch, at which point the contract between us ("Contract") will be formed.

3. As soon as you place your order, we start to process it, which means you will not be able to change it before delivery, but you may be able to return your products under our Returns Policy.

4. From time to time, we may make minor changes to a product to reflect changes in relevant laws and regulatory requirements.

5. These terms and conditions and any contract between us are only in the English language. Please note that we may not necessarily keep a copy of your contract. You should keep a copy of these terms and conditions and your order for future reference.

Prices and Taxes

All prices are stated in EUR, except for PLN for Poland, BGN for Bulgaria, CZK for the Czech Republic, HUF for Hungary, and RON for Romania, and include the value-added tax (country-specific VAT). Prices do not include delivery charges, which are indicated in the final value of the order before the order is confirmed electronically.

The Pantoneclo shop offers the following payment methods:

• Credit card, Debit card, Mastercard

• Cash on Delivery

Paying via our payment system is secure as it meets security standards with an SSL certificate. All products are genuine. All promotional offers are valid until the end of the promotion or while stocks last.

Order Placement

Orders can be placed on www.pantoneclo.com 24 hours a day, every day of the year. The consumer chooses and orders the products in the online store, classified under categories. Ordering in our online shop is easy and safe.

You can purchase in the Pantoneclo online store in five steps:

1. Choose the product or products and add them to the cart

2. Review the cart

3. Enter your account and delivery information

4. Select the delivery and payment method

5. Confirm the order

Your order will then be shipped as soon as possible.

After submitting the order, the buyer receives a notification by email that the order has been accepted. It lists the products and quantities selected by the buyer. For any changes to the order or cancellations, the buyer must inform the provider via email at [email protected], mentioning the purchase number, which is included in the purchase confirmation email.

Delivery

1. The order will be fulfilled by the delivery date set out in the dispatch confirmation. In any event, delivery will take place no more than 10 days after the day your contract is entered into.

2. If no one is available at the customer's address to take delivery and the products cannot be posted through your letterbox or left in a safe place, after two failed attempts, we may end the contract.

3. Delivery of your order will be complete when we deliver the products to the address you provided, and the products will be your responsibility from that time.

4. The customer will own the products once we have received payment in full.

5. The images of the products on our site and in our other advertising materials are for illustrative purposes only. Your products may vary slightly from those images. Although we have made every effort to display and print the colors of the products accurately, we cannot guarantee that your computer's display of the pictures, or the pictures in our other advertising materials, accurately reflect the colors of the products that will be delivered to you.

6. Working days exclude Saturday, Sunday, and Bank Holidays.

7. If you wish to dispute delivery of your order, you have 14 days starting from the day the tracking status for your order is updated by the carrier as fulfilled (i.e., updated as delivered to the address set out in the dispatch confirmation). We reserve the right to request evidence before issuing any refund of the price paid and/or any associated delivery costs.

Order Cancellation

When the consumer places an order, they will receive an email confirming receipt of the order. The consumer has the right to cancel the order before receiving an email notification from the Provider that the shipment will be handed over to the post. It is not possible to cancel the order at a later date.

The contract or order is sent to the email address entered by the buyer when placing the order.

The Pantoneclo Online Shop provides the technical means to identify and correct errors before the order is placed by warning the buyer if they have not filled in all the required fields. Before the order is finalized, a summary is available for the buyer to check and edit the data entered. In case of an incorrect entry, the buyer can correct the errors in the shopping cart.

If you wish to cancel your order before it has been dispatched, you must notify us by email at [email protected]. The cancellation request must contain the User's name and surname, and the order number.

Returns

1.     For details of the return process, please refer to our Return and Refund Policy.

2.     If you choose to return the products using any method other than one of our nominated carriers, you will remain responsible for the products, including any loss or damage, until we receive them.

3.     If we suspect fraudulent activity, including but not limited to circumstances where there are suspicious claims relating to orders not being received, items being returned after use or wear, items returned not matching the order, or counterfeit proof of return being provided, we reserve the right to withhold refunds and block your account (and any associated accounts) from placing future orders. If this happens and you believe we have made a mistake, please contact us, and we will discuss the matter with you further.

 Faulty Products

1.     If you are a consumer, we are under a legal duty to supply products that conform to the contract. Nothing in these terms and conditions will affect your legal rights in relation to products that are faulty or defective.

2.     If you consider that any product we have supplied is faulty or misdescribed, please notify us using the contact details provided.

3.     If you discover that your product is faulty after 14 days, we reserve the right to request evidence, such as images of the defect, before issuing any refund of the price paid and/or any associated delivery costs.

Customer Responsibility

The customer must verify the invoice data's correctness and notify Pantoneclo of any errors within seven (7) days of receipt. Subsequent complaints will be taken into consideration but may not be honored.

Pantoneclo is not responsible for fees associated with changes in exchange rates, surcharges set by your bank, or any additional fees for foreign currency transactions charged by the card issuer if EUR is not the currency in which the credit card issuer issues invoices.

Liability of Pantoneclo

1.     If we fail to comply with these terms and conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.

2.     We only supply the products for domestic and private use. If you use the products for any commercial, business, or resale purpose, we will have no liability to you for any loss of profit, loss of business, loss of anticipated savings, business interruption, or loss of business opportunity.

3.     We do not in any way exclude or limit our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any matter for which we may not exclude or limit our liability under any applicable law.

Our Rights to Cancel the Contract

Pantoneclo may end the contract at any time by writing to you if:

1.     You do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the products; or

2.     You do not, within a reasonable time, allow us to deliver the products to you.

If we end the contract in any of the situations set out above, we will refund any money you have paid in advance for the products we have not provided, but we may deduct or charge you reasonable compensation for the costs we incur as a result of your breach of the contract.

Resolving Any Claims

The buyer may submit a complaint by e-mail to [email protected]. The complaint procedure is confidential. In the event of any non-compliance, we will deal with any claims you may have in accordance with the provisions of ZVPot-1. If you identify a possible non-compliance, we will resolve your claim within a reasonable period of time from the time you notify us, which we will endeavor to keep to no more than 30 days. Pantoneclo will acknowledge receipt of the complaint within five working days and inform the buyer of the progress of the procedure within a further eight working days. Pantoneclo will use its best efforts to resolve any disputes amicably. If no amicable settlement is reached, the court in Ljubljana shall have jurisdiction to settle any disputes between Pantoneclo and the buyer. The provisions of the Code of Obligations, the Consumer Protection Act, and other relevant legislation of the Republic of Slovenia shall apply mutatis mutandis to all relationships, rights, and obligations not governed by these General Terms and Conditions.

Other Important Terms

1.     Nothing in these terms and conditions shall affect your rights as a consumer under the applicable law in the jurisdiction in which you are resident.

2.     If we have to contact you, we will do so in writing or by telephone, using the contact details you provided to us in your order. When we refer in these terms and conditions to “in writing”, this includes e-mail and SMS.

3.     We may change these terms and conditions from time to time. The terms and conditions that apply to your contract will be those displayed on our site when you place your order.

4.     We may transfer our rights and obligations under the contract to another organization. We will inform you in writing if this happens and will ensure that the transfer will not affect your rights under the contract.

5.     You may only transfer your rights or your obligations under these terms to another person if we agree in writing.

6.     The contract is between you and us. No other person shall have any rights to enforce any of its terms.

7.     Each of the paragraphs of these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

8.     If we fail to insist that you perform any of your obligations under these terms and conditions, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

9.     Please note that these terms and conditions are governed by Slovenian law. If you are a consumer, this means a contract for the purchase of products and any dispute or claim arising out of or in connection with it will be governed by Slovenian law.

10.  In respect of any dispute or claim relating to a contract, if you are a consumer, you and we both submit to the non-exclusive jurisdiction of the courts, but nothing in this clause shall limit your legal rights to bring actions against us or to require proceedings to take place in the country in which you have your usual place of residence.

Governing Law

Slovenian law governs these Terms and Conditions. The competent court in case of disputes resulting from this agreement is the courts in Slovenia. Pantoneclo does not recognize any out-of-court consumer dispute resolution provider as competent under the law to resolve a consumer dispute brought by a consumer under the Out-of-Court Settlement of Consumer Disputes Act. The invalidity of any general condition shall not invalidate other conditions.

আপনার অর্ডার যত তাড়াতাড়ি সম্ভব পাঠানো হবে। অর্ডার জমা দেওয়ার পরে, ক্রেতা ইমেলের মাধ্যমে একটি বিজ্ঞপ্তি পান যে অর্ডারটি গ্রহণ করা হয়েছে। এটি ক্রেতা দ্বারা নির্বাচিত পণ্য এবং পরিমাণ তালিকাভুক্ত করে। অর্ডার বা বাতিলকরণের যেকোনো পরিবর্তনের জন্য, ক্রেতাকে অবশ্যই [email protected]এ ইমেলের মাধ্যমে প্রদানকারীকে জানাতে হবে, ক্রয় নম্বর উল্লেখ করে, যা ক্রয় নিশ্চিতকরণ ইমেলে অন্তর্ভুক্ত রয়েছে।

ডেলিভারি

অর্ডারটি প্রেরণের নিশ্চিতকরণে সেট করা ডেলিভারির তারিখ দ্বারা পূরণ করা হবে। যে কোনো ক্ষেত্রে, ডেলিভারিটি আপনার চুক্তিতে প্রবেশের দিন ১০ দিনের বেশি হবে না। যদি ডেলিভারি নেওয়ার জন্য গ্রাহকের ঠিকানায় কেউ উপলব্ধ না হয় এবং পণ্যগুলি আপনার লেটারবক্সের মাধ্যমে পোস্ট করা যায় না বা নিরাপদ স্থানে রেখে দেওয়া না যায়, তবে দুটি ব্যর্থ প্রচেষ্টার পরে, আমরা চুক্তিটি শেষ করতে পারি আপনার প্রদত্ত ঠিকানায় আমরা পণ্য সরবরাহ করলে আপনার অর্ডারের ডেলিভারি সম্পূর্ণ হবে এবং সেই সময় থেকে পণ্যগুলি আপনার দায়িত্ব হবে। আমরা সম্পূর্ণ অর্থ প্রদানের পরে গ্রাহক পণ্যগুলির মালিক হবেন। আমাদের সাইটে এবং আমাদের অন্যান্য বিজ্ঞাপন সামগ্রীতে থাকা পণ্যগুলির ছবিগুলি শুধুমাত্র উদাহরণের উদ্দেশ্যে। আপনার পণ্য এই ছবি থেকে সামান্য পরিবর্তিত হতে পারে. যদিও আমরা পণ্যগুলির রঙগুলি সঠিকভাবে প্রদর্শন এবং মুদ্রণের জন্য সর্বাত্মক প্রচেষ্টা করেছি, তবে আমরা গ্যারান্টি দিতে পারি না যে আপনার কম্পিউটারের ছবিগুলির প্রদর্শন বা আমাদের অন্যান্য বিজ্ঞাপন সামগ্রীতে থাকা ছবিগুলি আপনাকে সরবরাহ করা পণ্যগুলির রঙকে সঠিকভাবে প্রতিফলিত করে৷ কর্মদিবসগুলি শনিবার, রবিবার এবং ব্যাঙ্ক ছুটির দিনগুলি বাদ দেয়৷ আপনি যদি আপনার অর্ডারের ডেলিভারি নিয়ে বিরোধ করতে চান, তাহলে আপনার অর্ডারের ট্র্যাকিং স্ট্যাটাস পরিপূর্ণ হওয়ার দিন থেকে শুরু করে 14 দিন আছে (অর্থাৎ, ডিসপ্যাচ নিশ্চিতকরণে সেট করা ঠিকানায় ডেলিভারি হিসাবে আপডেট করা হয়েছে)। আমরা প্রদত্ত মূল্য এবং/অথবা সংশ্লিষ্ট ডেলিভারি খরচের কোনো ফেরত প্রদানের আগে প্রমাণের অনুরোধ করার অধিকার সংরক্ষণ করি।

অর্ডার বাতিল

যখন ভোক্তা একটি অর্ডার দেয়, তখন তারা অর্ডারের প্রাপ্তি নিশ্চিত করে একটি ইমেল পাবে। সরবরাহকারীর কাছ থেকে একটি ইমেল বিজ্ঞপ্তি পাওয়ার আগে ভোক্তার অর্ডারটি বাতিল করার অধিকার রয়েছে যে চালানটি পোস্টে হস্তান্তর করা হবে। পরবর্তী তারিখে অর্ডার বাতিল করা সম্ভব নয়। চুক্তি বা অর্ডারটি অর্ডার দেওয়ার সময় ক্রেতা দ্বারা প্রবেশ করা ইমেল ঠিকানায় পাঠানো হয়। প্যান্টোনেক্লো অনলাইন শপ ক্রেতাদের সমস্ত প্রয়োজনীয় ক্ষেত্রগুলি পূরণ না করলে অর্ডার দেওয়ার আগে ত্রুটিগুলি সনাক্ত এবং সংশোধন করার প্রযুক্তিগত উপায় সরবরাহ করে৷ অর্ডার চূড়ান্ত হওয়ার আগে, প্রবেশ করা ডেটা পরীক্ষা এবং সম্পাদনা করার জন্য ক্রেতার জন্য একটি সারাংশ উপলব্ধ। একটি ভুল এন্ট্রির ক্ষেত্রে, ক্রেতা শপিং কার্টে ত্রুটিগুলি সংশোধন করতে পারেন। আপনি যদি আপনার অর্ডারটি পাঠানোর আগে বাতিল করতে চান তবে আপনাকে অবশ্যই [email protected]এ ইমেলের মাধ্যমে জানাতে হবে। বাতিলের অনুরোধে অবশ্যই ব্যবহারকারীর নাম এবং উপাধি এবং অর্ডার নম্বর থাকতে হবে।

রিটার্নস

1. ফেরত প্রক্রিয়ার বিস্তারিত জানার জন্য, অনুগ্রহ করে আমাদের রিটার্ন এবং রিফান্ড নীতি দেখুন।

2. আপনি যদি আমাদের মনোনীত ক্যারিয়ারগুলির একটি ব্যতীত অন্য কোনও পদ্ধতি ব্যবহার করে পণ্যগুলি ফেরত দিতে পছন্দ করেন তবে আমরা সেগুলি না পাওয়া পর্যন্ত আপনি যে কোনও ক্ষতি বা ক্ষতি সহ পণ্যগুলির জন্য দায়ী থাকবেন৷

3. যদি আমরা প্রতারণামূলক কার্যকলাপের সন্দেহ করি, যার মধ্যে রয়েছে কিন্তু সীমাবদ্ধ নয় এমন পরিস্থিতিতে যেখানে অর্ডার প্রাপ্ত না হওয়া, আইটেমগুলি ব্যবহার বা পরিধানের পরে ফেরত দেওয়া, অর্ডারের সাথে মেলে না আইটেমগুলি ফেরত দেওয়া, বা ফেরত দেওয়ার জাল প্রমাণ দেওয়া সংক্রান্ত সন্দেহজনক দাবি রয়েছে, আমরা রিফান্ড আটকে রাখার অধিকার সংরক্ষণ করুন এবং আপনার অ্যাকাউন্ট (এবং কোনো সংশ্লিষ্ট অ্যাকাউন্ট) ভবিষ্যতে অর্ডার দেওয়া থেকে ব্লক করুন। যদি এটি ঘটে এবং আপনি বিশ্বাস করেন যে আমরা একটি ভুল করেছি, অনুগ্রহ করে আমাদের সাথে যোগাযোগ করুন এবং আমরা আপনার সাথে বিষয়টি নিয়ে আলোচনা করব৷

 ত্রুটিপূর্ণ পণ্য

1. আপনি একজন ভোক্তা হলে, চুক্তির সাথে সঙ্গতিপূর্ণ পণ্য সরবরাহ করার জন্য আমাদের আইনগত দায়িত্ব রয়েছে। এই শর্তাবলীর কোন কিছুই ত্রুটিপূর্ণ বা ত্রুটিপূর্ণ পণ্যের ক্ষেত্রে আপনার আইনি অধিকারকে প্রভাবিত করবে না।

2. আপনি যদি বিবেচনা করেন যে আমরা সরবরাহ করেছি কোনো পণ্য ত্রুটিপূর্ণ বা ভুল বর্ণনা করা হয়েছে, তাহলে প্রদত্ত যোগাযোগের বিশদ ব্যবহার করে আমাদের জানান।

3. যদি আপনি আবিষ্কার করেন যে আপনার পণ্যটি 14 দিন পর ত্রুটিপূর্ণ, তাহলে আমরা প্রদত্ত মূল্য এবং/অথবা সংশ্লিষ্ট ডেলিভারি খরচের কোনো ফেরত দেওয়ার আগে প্রমাণের অনুরোধ করার অধিকার সংরক্ষণ করি, যেমন ত্রুটির ছবি।

গ্রাহকের দায়িত্ব

গ্রাহককে ইনভয়েস ডেটার সঠিকতা যাচাই করতে হবে এবং প্রাপ্তির সাত (7) দিনের মধ্যে প্যান্টোনেক্লোকে কোনো ত্রুটির বিষয়ে অবহিত করতে হবে। পরবর্তী অভিযোগ বিবেচনা করা হবে কিন্তু সম্মানিত নাও হতে পারে। বিনিময় হারে পরিবর্তনের সাথে সম্পর্কিত ফি, আপনার ব্যাঙ্ক দ্বারা সেট করা সারচার্জ, বা কার্ড ইস্যুকারীর দ্বারা চার্জ করা বৈদেশিক মুদ্রা লেনদেনের জন্য অতিরিক্ত ফিগুলির জন্য প্যান্টোনেক্লো দায়ী নয়।

প্যান্টোনেক্লোর দায়

1. যদি আমরা এই শর্তাবলী মেনে চলতে ব্যর্থ হই, তাহলে আপনার ক্ষতি বা ক্ষতির জন্য আমরা দায়ী যা আমাদের লঙ্ঘন বা যুক্তিসঙ্গত যত্ন এবং দক্ষতা ব্যবহারে আমাদের ব্যর্থতার একটি সম্ভাব্য ফলাফল। আমরা এমন কোনো ক্ষতি বা ক্ষতির জন্য দায়ী নই যা পূর্বাভাসযোগ্য নয়। ক্ষতি বা ক্ষয়ক্ষতি যদি স্পষ্ট হয় যে এটি ঘটবে বা যদি চুক্তিটি করা হয়েছিল, আমরা এবং আপনি উভয়েই জানতাম যে এটি ঘটতে পারে।

2. আমরা শুধুমাত্র গার্হস্থ্য এবং ব্যক্তিগত ব্যবহারের জন্য পণ্য সরবরাহ. আপনি যদি কোনো বাণিজ্যিক, ব্যবসায়িক বা পুনঃবিক্রয় উদ্দেশ্যে পণ্যগুলি ব্যবহার করেন, তাহলে আমাদের কোনো লাভের ক্ষতি, ব্যবসার ক্ষতি, প্রত্যাশিত সঞ্চয়ের ক্ষতি, ব্যবসায় বাধা বা ব্যবসার সুযোগ হারানোর জন্য আপনার কাছে কোনো দায় থাকবে না।

3. আমরা কোনোভাবেই আমাদের অবহেলা, জালিয়াতি, বা প্রতারণামূলক ভুল উপস্থাপনের কারণে মৃত্যু বা ব্যক্তিগত আঘাতের জন্য আমাদের দায় বর্জন বা সীমাবদ্ধ করি না, বা এমন কোনো বিষয় যার জন্য আমরা কোনো প্রযোজ্য আইনের অধীনে আমাদের দায় বাদ বা সীমাবদ্ধ করতে পারি না।

চুক্তি বাতিল করার জন্য আমাদের অধিকার

প্যান্টোনেক্লো যেকোন সময় আপনাকে লিখে চুক্তি শেষ করতে পারে যদি:

1. আপনি আমাদের জিজ্ঞাসা করার একটি যুক্তিসঙ্গত সময়ের মধ্যে, আমাদের পণ্য সরবরাহ করার জন্য প্রয়োজনীয় তথ্য সরবরাহ করবেন না; বা

2. আপনি, একটি যুক্তিসঙ্গত সময়ের মধ্যে, আমাদের আপনার কাছে পণ্য সরবরাহ করার অনুমতি দেবেন না।

যদি আমরা উপরে উল্লিখিত যেকোনো পরিস্থিতিতে চুক্তিটি শেষ করি, তাহলে আমরা যে পণ্যগুলি সরবরাহ করিনি তার জন্য আপনি অগ্রিম প্রদান করেছেন এমন কোনও অর্থ আমরা ফেরত দেব, তবে আমরা এর ফলে আমাদের যে খরচ হয় তার জন্য আমরা আপনার থেকে যুক্তিসঙ্গত ক্ষতিপূরণ কাটতে বা চার্জ করতে পারি। আপনার চুক্তি লঙ্ঘন।

যেকোনো দাবির সমাধান করা

ক্রেতা [email protected]এ ই-মেইলের মাধ্যমে অভিযোগ জমা দিতে পারেন। অভিযোগ প্রক্রিয়া গোপনীয়, বিধান অনুযায়ী আপনার যে কোনো দাবি আমরা মোকাবেলা করব। যদি আপনি একটি সম্ভাব্য অ-সম্মতি সনাক্ত করেন, তাহলে আপনি আমাদের অবহিত করার সময় থেকে আমরা আপনার দাবির একটি যুক্তিসঙ্গত সময়ের মধ্যে সমাধান করব, যা আমরা 30 দিনের বেশি না রাখার চেষ্টা করব। Pantoneclo পাঁচ কার্যদিবসের মধ্যে অভিযোগের প্রাপ্তি স্বীকার করবে এবং আরও আট কার্যদিবসের মধ্যে প্রক্রিয়াটির অগ্রগতি সম্পর্কে ক্রেতাকে অবহিত করবে। প্যান্টোনেক্লো যেকোন বিরোধকে বন্ধুত্বপূর্ণভাবে সমাধান করার জন্য তার সর্বোত্তম প্রচেষ্টা ব্যবহার করবে। যদি কোনো বন্ধুত্বপূর্ণ মীমাংসা না হয়, তবে প্যান্টোনেক্লো এবং ক্রেতার মধ্যে যে কোনো বিরোধ নিষ্পত্তি করার এখতিয়ার Ljubljana আদালতের থাকবে। বাধ্যবাধকতা কোড, ভোক্তা সুরক্ষা আইন, এবং স্লোভেনিয়া প্রজাতন্ত্রের অন্যান্য প্রাসঙ্গিক আইনের বিধানগুলি এই সাধারণ শর্তাবলী দ্বারা নিয়ন্ত্রিত নয় এমন সমস্ত সম্পর্ক, অধিকার এবং বাধ্যবাধকতার ক্ষেত্রে মিউটটিস মিউট্যান্ডিস প্রয়োগ করবে৷

অন্যান্য গুরুত্বপূর্ণ শর্তাবলী

1. আপনি যে এখতিয়ারে বসবাস করছেন সেখানে প্রযোজ্য আইনের অধীনে ভোক্তা হিসাবে এই শর্তাবলীর কোনো কিছুই আপনার অধিকারকে প্রভাবিত করবে না।

2. যদি আমাদের আপনার সাথে যোগাযোগ করতে হয়, আমরা তা লিখিতভাবে বা টেলিফোনে করব, আপনার অর্ডারে আমাদের দেওয়া যোগাযোগের বিবরণ ব্যবহার করে। যখন আমরা এই শর্তাবলী "লিখিতভাবে" উল্লেখ করি, এতে ই-মেইল এবং এসএমএস অন্তর্ভুক্ত থাকে।

3. আমরা সময়ে সময়ে এই শর্তাবলী পরিবর্তন করতে পারি। আপনি আপনার অর্ডার দেওয়ার সময় আপনার চুক্তিতে প্রযোজ্য শর্তাবলী আমাদের সাইটে প্রদর্শিত হবে।

4. আমরা চুক্তির অধীনে আমাদের অধিকার এবং বাধ্যবাধকতাগুলি অন্য সংস্থার কাছে হস্তান্তর করতে পারি৷ এটি ঘটলে আমরা আপনাকে লিখিতভাবে জানাব এবং নিশ্চিত করব যে স্থানান্তর চুক্তির অধীনে আপনার অধিকারকে প্রভাবিত করবে না।

5. যদি আমরা লিখিতভাবে সম্মত হন তবে আপনি শুধুমাত্র এই শর্তাবলীর অধীনে আপনার অধিকার বা আপনার বাধ্যবাধকতাগুলি অন্য ব্যক্তির কাছে হস্তান্তর করতে পারেন।

6. চুক্তি আপনার এবং আমাদের মধ্যে হয়. অন্য কোন ব্যক্তির কোন শর্তাবলী প্রয়োগ করার কোন অধিকার থাকবে না।

7. এই শর্তাবলীর প্রতিটি অনুচ্ছেদ আলাদাভাবে কাজ করে৷ যদি কোন আদালত বা প্রাসঙ্গিক কর্তৃপক্ষ সিদ্ধান্ত নেয় যে তাদের মধ্যে যেকোন একটি বেআইনি বা অপ্রয়োগযোগ্য, অবশিষ্ট অনুচ্ছেদগুলি পূর্ণ বল এবং কার্যকর থাকবে।

8. যদি আমরা এই শর্তাবলীর অধীনে আপনার কোনো বাধ্যবাধকতা পালন করার জন্য জোর দিতে ব্যর্থ হই, অথবা যদি আমরা আপনার বিরুদ্ধে আমাদের অধিকার প্রয়োগ না করি, বা যদি আমরা তা করতে দেরি করি, তাহলে এর অর্থ এই নয় যে আমরা আমাদের অধিকার পরিত্যাগ করেছি। আপনি এবং এর অর্থ এই নয় যে আপনাকে সেই বাধ্যবাধকতাগুলি মেনে চলতে হবে না। যদি আমরা আপনার দ্বারা একটি ডিফল্ট পরিত্যাগ করি, আমরা শুধুমাত্র লিখিতভাবে তা করব, এবং এর অর্থ এই নয় যে আমরা স্বয়ংক্রিয়ভাবে আপনার পরবর্তী কোনো ডিফল্ট পরিত্যাগ করব৷

9. দয়া করে মনে রাখবেন যে এই শর্তাবলী বাংলাদেশের আইন দ্বারা নিয়ন্ত্রিত হয়৷ আপনি যদি একজন ভোক্তা হন, তাহলে এর অর্থ পণ্য ক্রয়ের জন্য একটি চুক্তি এবং এর থেকে বা এর সাথে সম্পর্কিত যে কোনো বিরোধ বা দাবি স্লোভেনীয় আইন দ্বারা পরিচালিত হবে।

10. কোনো চুক্তি সম্পর্কিত কোনো বিরোধ বা দাবির ক্ষেত্রে, আপনি যদি একজন ভোক্তা হন, আপনি এবং আমরা উভয়েই আদালতের অ-একচেটিয়া এখতিয়ারের কাছে জমা দিই, কিন্তু এই ধারার কোনো কিছুই আমাদের বিরুদ্ধে ব্যবস্থা নেওয়ার জন্য আপনার আইনি অধিকারকে সীমিত করবে না অথবা যে দেশে আপনার স্বাভাবিক বসবাসের জায়গা আছে সেই দেশে বিচারের প্রয়োজন।

পরিচালনা আইন

বাংলাদেশের আইন এই শর্তাবলী নিয়ন্ত্রণ করে। এই চুক্তির ফলে বিরোধের ক্ষেত্রে উপযুক্ত আদালত হল বাংলাদেশের আদালত। Pantoneclo ভোক্তা বিরোধ নিষ্পত্তি আইনের অধীনে একজন ভোক্তার দ্বারা আনা একটি ভোক্তা বিরোধ নিষ্পত্তি করার জন্য আইনের অধীনে আদালতের বাইরের কোনো ভোক্তা বিরোধ নিষ্পত্তি প্রদানকারীকে যোগ্য হিসেবে স্বীকৃতি দেয় না। কোনো সাধারণ শর্তের অবৈধতা অন্য শর্তকে অবৈধ করবে না।
